10:10:01 AM Commissioner Mitchell Comments, I move that we approve the preliminary plat for the Piazza Subsequent Minor Subdivision amended plat of Tract 1A, of the amended plat of Middle Creek Meadows #3, COS 595, finding that the legal and physical access for lot 2 directly onto Huffine Lane does satisfy the public health and safety primary criteria and that they have received the Montana Department of Transportations blessing on this situation and that in this particular case the county Subdivision Regulation Section 7.A.4, calling for separation of through and local traffic doesn't really bear on this proposal. This is an area of development and densification. Also finding that the application does comply with the goals and policy of the Gallatin County Growth Policy, again this is an area of future densification. Finding that the application meets the requirement of Section 76-3-608 MCA of the Montana Subdivision and Platting Act and finding that the application complies with the provisions of the Gallatin County Subdivision Regulations with all of the conditions as suggested by staff as part of the approval.

10:52:43 AM County Attorney Marty Lambert Reconvene to meeting-Suggested adding to condition #8 of staff report on page 5 of 10, as a homeowners covenant (s) to read as follows: Perimeter Fuel Break Required. The Property Owners Association shall provide a fuel break around the perimeter of the subdivision. All actions related to the fuel breaks shall be at their expense. The fuel break shall be made and maintained as close as possible to the west boundary of the lots along the entire east boundary of the ridge. The fuel break shall be a 24 foot wide strip of either disked or plowed ground or vegetation mown with a height after mowing of not greater than 4 inches. The fuel break shall be maintained (disked, plowed, or mown) a minimum of twice each year. The first maintenance shall be not later than July 30th and the second maintenance not later than August 30th each year.
